THE FOLLOWING TERMS AND CONDITIONS WILL GOVERN YOUR USE OF THE SERVICE PROVIDED BY KENNY ROGERS ROASTERS (“KENNY ROGERS ROASTERS”).
Service. In order to use Kenny Rogers ROASTERS’s Service, you must obtain access to the World Wide Web, either direct or indirectly whether using personal computers or through devices that access web-based content.
Use of Account. You are responsible for all use of your account and for the security of your login identification, your password and any security lock code that you use to protect access to your data, your file name(s) and files, network and user access.
Subscriber Information. You must provide Kenny Rogers ROASTERS with accurate, complete, and updated information required by the registration to the Service ("Online Registration Form"), including your legal name, address, and NRIC/Passport number. You must notify Kenny Rogers ROASTERS of any changes in your registration data. You acknowledge that in exchange for the ability to use the Service, Kenny Rogers ROASTERS may gather information about you, such as data about your use of the Service or responses to questionnaires and surveys.
Indemnity. You agree to defend, indemnify and hold harmless Kenny Rogers ROASTERS, its parent and subsidiary companies and affiliates including the third party who contribute to the Service and their respective directors, officers, employees and agents from and against all claims, losses and expenses whatsoever and howsoever arising (including without limitation to legal fees incurred) arising out of your use or misuse of the Service of the Software.
Limitation of Liability. Under no circumstances shall Kenny Rogers ROASTERS, its parent, subsidiary companies or affiliates be liable for any direct, indirect, special or incidental damages whatsoever and howsoever arising (including without limitation to the loss of profits) even if Kenny Rogers ROASTERS has been advised of the possibility of such damages.
Choice of Law and Forum. This Agreement shall be governed by and construed in accordance with the laws of Malaysia, excluding its conflicts of law. You agree that the exclusive jurisdiction for any claim or action arising out of or relating to this Agreement or your use of the Services shall be filed only in the courts located in Malaysia.
International Use. Kenny Rogers ROASTERS does not make any representation that the content or materials of the Service is appropriate or available for use in locations outside Malaysia, or that they comply with any legal or regulatory requirements of such other locations. Those who choose to access the Service do so at their own risk and their own initiative and are responsible for compliance with local laws, to the extent that any local laws are applicable.
Information for Contest or Promotion. Additionally, you should be aware that when you voluntarily disclose "Personal Information", such information, along with any substantive information disclosed in your communication, may be collected and used by Kenny Rogers ROASTERS in its discretion for promotional and other purposes. Upon request, Kenny Rogers ROASTERS will use reasonable efforts to allow you to update/correct Personal Information previously submitted through the Service which you state is erroneous to the extent such activities will not compromise privacy or security interests.
Disclaimer of Warranties. KENNY ROGERS ROASTERS HAS PROVIDED LINKS AND POINTERS TO INTERNET SITES MAINTAINED BY THIRD PARTIES ("THIRD PARTY SITES") AND MAY FROM TIME TO TIME PROVIDE THIRD PARTY MATERIALS ON THIS SERVICE. NEITHER KENNY ROGERS ROASTERS, ITS PARENT NOR SUBSIDIARY COMPANIES NOR ITS AFFILIATES OR SUPPLIERS OPERATE OR CONTROL IN ANY RESPECT ANY INFORMATION, PRODUCTS OR SERVICES ON THESE THIRD PARTY SITES. THE MATERIALS IN THE SERVICE AND THE THIRD PARTY SITES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, KENNY ROGERS ROASTERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. KENNY ROGERS ROASTERS DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIALS AND PRODUCTS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SERVICE, INCLUDING THE COMMUNITY AREAS, OR THE SERVER THAT MAKES THEM AVAILABLE, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. KENNY ROGERS ROASTERS DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE MATERIALS IN THIS SERVICE OR IN THIRD PARTY SITES IN TERMS OF THEIR CORRECTNESS, ACCURACY, TIMELINESS, RELIABILITY OR OTHERWISE. YOU ASSUME ALL RISK OF ERRORS AND/OR OMISSIONS IN THE SERVICE, INCLUDING THE TRANSMISSION OR TRANSLATION OF INFORMATION. YOU ASSUME FULL RESPONSIBILITY FOR IMPLEMENTING SUFFICIENT PROCEDURES AND CHECKS TO SATISFY YOUR REQUIREMENTS FOR THE ACCURACY AND SUITABILITY OF THE SERVICE, INCLUDING THE INFORMATION, AND FOR MAINTAINING ANY MEANS WHICH YOU MAY REQUIRE FOR THE RECONSTRUCTION OF LOST DATA OR SUBSEQUENT MANIPULATIONS OR ANALYSES OF THE INFORMATION PROVIDED HEREUNDER. YOU ASSUME THE ENTIRE COST OF ALL NECESSARY MAINTENANCE, REPAIR OR CORRECTION.
Variation of Terms and Conditions. Kenny Rogers ROASTERS reserves the right to vary any or all of the terms and conditions herein in such manner as Kenny Rogers ROASTERS may deem fit from time to time.
Miscellaneous. This Agreement and any posted operating rules constitute the entire agreement of the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written between the parties with respect to such subject matter.
